There is a problem within the structure of the Dayton Township government which is evident based upon the actions and inactions of three Dayton Township officials:  the Zoning Administrator – Bob Cook; the Blight Admin-istrator – Bob Cook; and the Township Supervisor – Bob Cook.

Bob Cook, Zoning Administrator, has NO right to do selective enforcement. Our Day-ton Township Zoning Ordinance specifically states in Section 3.02 of the Zoning Ordinance, “Under no circumstances is the Zoning Admin-istrator permitted to make changes in this Ordinance, nor to vary the terms of this Ordinance while carrying out the duties prescribe herein. It shall be the responsibility of the Zoning Administrator to enforce the provisions of this Ordinance…”.

The following ordinances have been purposely manipulated:

Article 8, Noncon-forming Structures, Sec-tion 8.04 B

“Should such structure be destroyed by any means to an extent of more than sixty percent of its appraised replacement costs, exclusive of the foundation, it shall NOT be reconstructed except in conformance with the provisions of this Ordinance, includ-ing the respective site development standards for the District in which it is located.” In this case, R1.

Section 19.23

B. All dwellings must be firmly attached to a permanent foundation or a masonry wall or skirting.

C. Shall not have exposed undercarriage or chassis.

D. Sewer and water approved by county health dept.

E. Outside storage space of better or equal quality than the principal dwelling and equal to 10 percent of living area.

F. The dwelling shall be aesthetically compatible with other residences in the area. within 2000 ft.

The minimum size of residences is 1000 square feet of livable space.

3.03A requires Land Use Permit, Plot Plan or Site Plan and a Building Permit.

3.03F No structure or use shall be occupied without first receiving a certificate of occupancy permit from the Building Inspector.

Specifically does not allow livestock in an R-3 zoned area.

3.05 Penalties and Remedies

A violation is a misdemeanor. Any person, this includes the members of the Zoning Board of Appeals, the Planning Commission AND the Township Board, who commits, participates in, assists in, or maintains such violation may be found guilty and suffer the penalties:  $500 fine or 30 days, or both, and shall pay all costs and expenses involved in the case. Every day such violation continues shall be considered a separate offense.

3.05b

Township board may institute injunction, mandamus, abatement or other appropriate proceedings to prevent, enjoin, abate, or remove any violations of this Ordinance.

We suggest concerned citizens attend the   next Dayton Township Board Meeting on Sept 2nd at 7:30.
